Terms of Service

1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you and Maildriply (“we”, “us”), governing your use of Maildriply (“the Service”). By signing in to the Service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

Maildriply is a tool that helps you send emails through your own Google or Google Workspace account using the Gmail API and provides open, click, and unsubscribe analytics for those emails. The Service does not deliver mail through any third-party SMTP relay; all sending is performed against your connected Gmail account using the gmail.send OAuth scope you grant.

3. Eligibility and account

  • You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract.
  • You are responsible for the security of the Google account you connect, the contents of the messages you send, and the people you send them to.
  • One person or organisation per Gmail mailbox. Sharing credentials is not permitted.

4. Acceptable use

You agree not to use the Service to:

  • Send unsolicited bulk email, “spam”, or any message in violation of CAN-SPAM, CASL, GDPR, ePrivacy, or any other applicable anti-spam, marketing, or data-protection law.
  • Send to recipients who have not given you a lawful basis to email them, or who have unsubscribed from your communications.
  • Impersonate any person or entity, falsify the From or Reply-To address, or otherwise misrepresent your identity.
  • Distribute malware, phishing content, child sexual abuse material, content inciting violence, or any material that infringes the intellectual property or privacy rights of others.
  • Send unsolicited commercial email at a rate that materially damages Gmail's sending reputation. The Service applies built-in warm-up and daily-quota limits; you agree not to attempt to bypass them.
  • Probe, scan, reverse engineer, or otherwise attempt to discover non-public aspects of the Service, or interfere with its operation.
  • Use the Service to train any machine-learning model on Google user data obtained through your account.

We may suspend or terminate accounts that violate these terms or that put deliverability of other accounts at risk. Repeat offenders will be permanently banned.

5. Your content

You retain all rights to the email content, recipient lists, and templates you create through the Service. You grant us a limited, non-exclusive, royalty-free license to host, transmit, and process that content solely to operate the Service for you. We do not use your content to train AI models, advertise, or for any purpose outside operating the Service.

6. CAN-SPAM and one-click unsubscribe

Every message sent through Maildriply includes a List-Unsubscribe header and a one-click unsubscribe endpoint compliant with RFC 8058. You are responsible for ensuring your message body itself complies with applicable disclosure rules, including a physical mailing address where required by law and an accurate “from” identity.

7. Third-party services

The Service depends on Google APIs, Supabase, Heroku, Vercel, Upstash, and Datadog. Their respective terms govern those parts of the stack. We are not responsible for outages or policy changes they impose, but will make reasonable effort to notify you.

8. Fees

The Service is offered with a free tier and optional paid plans described on the pricing page. Paid plans are billed in advance and are non-refundable except where required by law. We may change prices with at least 30 days' notice.

9. Termination

You may terminate at any time by deleting your account in Settings or by emailing support@maildriply.com. We may suspend or terminate your access for material breach of these Terms, abuse of the Service, or if we are required by law to do so. On termination, the deletion procedures in our Privacy Policy apply.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, that messages will be delivered, that opens and clicks will be measured perfectly, or that the Service is free of bugs.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, REVENUE, DATA, OR GOODWILL.

12. Indemnity

You agree to indemnify, defend, and hold us harmless from any claim, liability, damage, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) your messages and recipient lists, or (c) your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Maildriply resides, without regard to conflict-of-laws principles. Disputes will be resolved exclusively in the state and federal courts of that jurisdiction, except that either party may seek injunctive relief in any competent court.

14. Changes

We may update these Terms from time to time. Material changes will be announced in the dashboard. Continued use of the Service after the effective date of the updated Terms constitutes acceptance.
